1. Introduction
These Terms of Service ("Terms") govern your use of the website https://chintamangardener.in (the "Website") and the gardening, landscaping, and maintenance services ("Services") provided by Chintaman Gardeners ("we", "us", "our"), operating in Mumbai, Navi Mumbai, Thane, and Panvel, Maharashtra, India.
By accessing our Website or engaging our Services, you ("Client", "you", "your") agree to be bound by these Terms. If you do not agree, please do not use our Website or Services.
2. Services We Provide
Chintaman Gardeners offers 55+ professional gardening and landscaping services, including but not limited to:
- Garden maintenance (weekly, bi-weekly, monthly)
- Terrace and balcony garden design and installation
- Vertical garden and green wall installation
- Landscape design and consultation
- Lawn installation and maintenance
- Waterfall, fountain, and water feature installation
- Pergola and gazebo construction
- Irrigation and drip system setup
- Tree pruning, transplanting, and removal
- Commercial and society garden maintenance
Service availability may vary by location and season. Specific services, scope, and deliverables are confirmed in writing (via quotation or project agreement) before work begins. The information on our Website is for general reference and does not constitute a binding offer.
3. Service Area
We serve properties across Mumbai, Navi Mumbai, Thane, and Panvel, covering 98+ localities. Service availability in remote areas or locations outside our standard coverage may require an additional site visit charge, which will be communicated upfront.
4. Consultation and Site Visits
- We offer a free initial consultation and site visit for most projects within our service area.
- During the site visit, our team will assess your space, discuss your requirements, and take measurements as needed.
- A detailed written quotation will be provided within 3-5 business days of the site visit.
- The consultation and quotation are provided without obligation. You are free to proceed or decline.
- For repeat consultations or design revisions beyond the initial scope, nominal charges may apply, which will be communicated in advance.
5. Quotations and Pricing
- All quotations are provided in Indian Rupees (INR) and are valid for 30 days from the date of issue, unless stated otherwise.
- Quotations include a detailed breakdown of materials, labour, plant costs, and any applicable taxes.
- Prices are based on the scope of work assessed during the site visit. Any changes to scope requested after the quotation is accepted may result in revised pricing.
- Prices of plants and materials are subject to market fluctuations. If there is a significant price change between quotation and project start, we will notify you and seek approval before proceeding.
- Travel or transportation charges for distant locations or heavy materials will be itemised separately in the quotation.
6. Payment Terms
Payment terms are agreed upon before project commencement and documented in the project agreement. Standard terms are as follows:
6.1 For Installation and Design Projects
- Advance payment: 40-50% of the total quotation amount, payable upon acceptance of the quotation and before work begins
- Progress payment: 30-40% upon completion of the midpoint milestone (as defined in the project agreement)
- Final payment: Remaining balance upon project completion and client inspection
6.2 For Maintenance Contracts (AMC)
- Monthly or quarterly payment as specified in the maintenance agreement
- Payment is due within 7 days of invoice date
6.3 Accepted Payment Methods
We accept payment via bank transfer (NEFT/RTGS/IMPS), UPI, cheque, and cash. We do not collect payment card details through our Website.
6.4 Late Payments
If payment is not received within 15 days of the due date, we reserve the right to pause ongoing work until payment is received. For maintenance contracts, service may be suspended after 30 days of non-payment.
7. Project Timelines
- Estimated project timelines are provided in the quotation or project agreement. These are good-faith estimates and not guaranteed deadlines.
- Timelines may be affected by weather conditions (especially during monsoon season), material availability, plant sourcing, and access to the property.
- We will promptly communicate any expected delays and work with you to minimise disruption.
- Delays caused by the Client (e.g., restricted property access, pending approvals, or scope changes) are not attributable to us and may result in timeline extensions.
8. Client Responsibilities
To ensure smooth project execution, the Client agrees to:
- Provide timely access to the property for site visits, material delivery, and work execution
- Ensure water supply is available at the work site during installation and for ongoing plant care
- Obtain any necessary permissions from housing societies, building management, or local authorities before work begins (we can assist with this process)
- Communicate any specific requirements, concerns, or changes promptly
- Follow our post-installation care instructions to ensure plant survival and garden health
- Clear the work area of personal belongings or valuables before our team arrives
9. Warranty and Plant Guarantee
9.1 Workmanship Warranty
We warrant that all installation work (structural elements, irrigation systems, waterproofing, hardscaping) will be free from defects in workmanship for a period of 6 months from the date of project completion. If a defect arises due to our workmanship during this period, we will repair or replace the affected work at no additional cost.
9.2 Plant Survival Guarantee
- Where specified in the project agreement, we offer a 30-day plant replacement guarantee from the date of planting.
- This guarantee is conditional on the Client following our care instructions, providing adequate watering, and not altering the planted area.
- The guarantee does not cover plant damage caused by pests, extreme weather events, construction activity, negligence, or third-party interference.
- Seasonal and ornamental plants that have a naturally short lifespan are excluded from the guarantee.
9.3 Maintenance Contract Warranty
For properties under an active Annual Maintenance Contract (AMC) with us, plant health and replacement are covered as part of the maintenance agreement, subject to the terms specified therein.
10. Cancellations and Refunds
10.1 Cancellation by Client
- Before work begins: If you cancel after paying the advance but before any work or material procurement has started, we will refund the advance in full, minus a 10% administrative fee.
- After work has started: If you cancel after work has begun, you will be charged for all work completed, materials purchased or ordered, and a reasonable cancellation fee. The balance, if any, will be refunded within 15 business days.
- Custom or perishable materials: Plants, soil, custom-fabricated structures, and other perishable or made-to-order items that have already been procured are non-refundable.
10.2 Cancellation by Us
We reserve the right to cancel or decline a project if the property is unsafe, if required permissions are not obtained, or if the Client fails to meet payment obligations. In such cases, we will refund any unused advance after deducting costs incurred.
11. Scope Changes
Any changes to the agreed scope of work must be communicated in writing (WhatsApp, email, or signed change order). We will provide a revised quotation for additional work, and the revised scope will proceed only upon your written approval. Verbal requests for changes are not binding.
12. Property Access and Safety
- Our team will take reasonable care to protect your property during work. We will clean the work area upon project completion.
- Minor surface marks from soil, water, or equipment may occur during gardening work. We are not liable for cosmetic marks that are part of normal gardening operations.
- We carry basic liability coverage. However, pre-existing property damage, damage caused by structural issues, or damage resulting from inaccurate information provided by the Client is not our responsibility.
- The Client must inform us of any underground utilities (pipes, cables, septic tanks) in the work area. We are not liable for damage to undisclosed underground infrastructure.
13. Limitation of Liability
- Our total liability for any claim arising from our Services shall not exceed the total amount paid by you for the specific service in question.
- We are not liable for indirect, incidental, or consequential damages, including loss of property value, loss of enjoyment, or business interruption.
- We are not responsible for outcomes affected by factors beyond our control, including weather, natural disasters, pest infestations, municipal actions, or the Client's failure to follow care instructions.
- Plant growth, flowering patterns, and garden appearance are influenced by many natural factors. While we use our expertise to deliver the best results, we do not guarantee specific aesthetic outcomes.
14. Intellectual Property
- All content on our Website -including text, images, designs, logos, and photographs -is the property of Chintaman Gardeners and is protected by applicable intellectual property laws.
- Custom landscape designs and garden plans created for your project remain our intellectual property until full payment is received, at which point a licence to use the design for your property is granted.
- You may not reproduce, distribute, or use our Website content, designs, or photographs for commercial purposes without our written consent.
- We may photograph completed projects for our portfolio and marketing materials. If you prefer your project not to be featured, please inform us in writing before project completion.
15. Website Use
- The information on our Website is provided for general informational purposes. While we strive for accuracy, service descriptions, images, and pricing are indicative and may change without notice.
- You agree not to use our Website for any unlawful purpose, to submit false or misleading information through our contact forms, or to attempt to interfere with the Website's operation.
- We are not responsible for the content or practices of third-party websites linked from our Website (e.g., WhatsApp, Google Maps, social media platforms).
- Gallery images represent our actual completed projects. Results may vary based on your specific property, climate conditions, and maintenance.
16. Force Majeure
We shall not be liable for delays or failure to perform our obligations if caused by events beyond our reasonable control, including but not limited to: natural disasters, floods, cyclones, earthquakes, epidemics, pandemics, government orders, lockdowns, strikes, supply chain disruptions, or prolonged unseasonal weather. In such cases, timelines will be extended by a reasonable period, and we will communicate the expected impact promptly.
17. Dispute Resolution
- Informal resolution: We encourage you to contact us first to resolve any concerns. Most issues can be resolved through direct communication.
- Mediation: If informal resolution is not successful, both parties agree to attempt mediation before pursuing legal action.
- Jurisdiction: Any disputes that cannot be resolved through mediation shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.
18. Changes to These Terms
We may update these Terms from time to time. When we make changes, the "Last updated" date at the top of this page will be revised. Changes will apply to services engaged after the updated Terms are published. For ongoing projects, the Terms in effect at the time of the project agreement will apply.
19. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
20. Governing Law
These Terms are governed by and construed in accordance with the laws of India. The Consumer Protection Act, 2019 and other applicable Indian laws shall apply to all transactions and services provided by us.
